You must secure an environmental permit before considering your Industrial Business License (IUI) in Indonesia. This is not just a legal requirement; it’s a crucial step that cannot be skipped. It’s all based on Regulation No. 32 of 2009, Environmental Protection and Management.

It’s the first step before applying for your IUI, and the entire process is managed through the OSS RBA system (Online Single Submission Risk-Based Approach). This article will help you identify the best permit for your business and the necessary documents for the application process.

What is an Environmental Permit and Why It Matters for IUI

An environmental permit is an official approval from the Indonesian government that shows your business activities are environmentally safe and compliant with regulations.

You must get this permit before applying for your Industrial Business License. Depending on your business type, location, and environmental impact, you will need one of the following:

  • AMDAL (Environmental Impact Analysis): For large, high-risk industries.
  • UKL-UPL (Environmental Management and Monitoring Efforts): For medium-sized businesses.
  • SPPL (Statement of Environmental Management Capability): For small, low-risk businesses.

These permits are required under:

  • Regulation No. 32 of 2009 on Environmental Protection and Management
  • Government Regulation No. 22 of 2021 on Environmental Protection and Management
  • Ministry of Environment Regulation No. 4 of 2021 on Environmental Documents

Without an environmental permit, you won’t be able to move forward with your IUI application.

AMDAL, UKL‑UPL, or SPPL: Which One Fits Your Business?

Choosing the correct environmental permit depends on your business size and potential ecological impact. Here’s how to know which one fits your needs:

AMDAL

AMDAL stands for Analisis Mengenai Dampak Lingkungan, or Environmental Impact Analysis.

  • Required for large-scale projects or businesses that could significantly affect the environment.
  • Common in manufacturing, mining, petrochemicals, and large infrastructure projects.
  • It often applies to businesses near protected areas, forests, rivers, or those handling hazardous materials.

UKL-UPL

UKL-UPL stands for Upaya Pengelolaan Lingkungan and Upaya Pemantauan Lingkungan, meaning Environmental Management and Monitoring Efforts.

  • Designed for medium-sized businesses that have a moderate impact on the environment.
  • Suitable for most companies applying for an industrial license in business districts or industrial zones.
  • Common in manufacturing, logistics, and service industries.

SPPL

SPPL is short for Surat Pernyataan Kesanggupan Pengelolaan dan Pemantauan Lingkungan, or Statement of Environmental Management and Monitoring Commitment.

  • Intended for small, low-risk businesses.
  • Easy to process and usually sufficient for micro-enterprises, home-based industries, or retail.
  • Ideal for businesses with minimal or no significant environmental impact.

Use the OSS RBA system to check your risk level, which is determined by the potential ecological impact of your business. Once you know the correct type of permit based on your risk level, you can proceed with your Industrial Business License application.

Required Documents for Each Type of Environmental Permit

Before applying for your Industrial Business License, you’ll need the correct environmental permit based on your business risk level. Each permit type comes with its own documentation.

AMDAL (High-Risk Businesses)

AMDAL is required for large-scale operations with significant environmental impact. The documents are more detailed and usually include:

  • Environmental impact assessments
  • Management and monitoring plans
  • Supporting business and location documents

This process often involves expert reviews and community involvement.

UKL-UPL (Medium-Risk Businesses)

Most medium-sized businesses fall under this category. To apply, you’ll typically need:

  • A completed UKL-UPL form
  • Business identity documents (e.g., NIB)
  • Basic project and location details

This is the most common permit required for industrial sectors applying for an IUI.

SPPL (Low-Risk Businesses)

SPPL is for small businesses with minimal environmental impact. It requires only basic documentation, such as:

  • A simple declaration form
  • Business identity and location info

How to Apply for Environmental Permits

Applying for an environmental permit in Indonesia is done entirely through the OSS RBA system, a government platform that manages business licensing based on risk levels. The process generally involves:

  • Registering your business and getting your NIB (Business Identification Number)
  • Filling out the required environmental form (AMDAL, UKL-UPL, or SPPL)
  • Uploading supporting documents based on your business type
  • Submitting your application for review

While the system is designed to be digital and accessible, navigating the requirements can still be confusing, especially if you’re unsure which permit type best suits your business. But don’t worry, we’re here to guide you through it.
