What Happens After SP2DK? Tax Issues, Outcomes, and Audit Risks

Understanding what happens after SP2DK in Indonesia is important since submitting a response doesn’t automatically resolve the tax issue. The Directorate General of Taxes (DJP) must first review the company’s explanation, supporting documents, tax returns, and any corrections made during the clarification process.

Depending on the findings, the SP2DK may be closed, followed by further discussion, resolved through a tax return correction, or escalated into a tax audit

Key Takeaways

  • After receiving an SP2DK response, DJP reviews whether the explanation and supporting evidence resolve the identified tax issue.
  • The SP2DK outcome may include case completion, voluntary correction, further clarification, another compliance review, or a tax audit.
  • Submitting a response doesn’t automatically close the SP2DK; companies should wait for formal confirmation from DJP.
  • DJP may issue an SP3 P2DK to communicate the case status, but the letter may still require further action.
  • Incomplete or inconsistent SP2DK responses can increase audit risk, so companies should also address the root cause after the case ends.

SP2DK Outcomes and Next Steps at a Glance

Possible Status What It Means What the Company Should Do
SP2DK cancelled The request is withdrawn due to an administrative, procedural, or data-related reason Keep the notice and confirm that no replacement letter has been issued
Clarification completed DJP considers the explanation process completed Retain the response, supporting documents, and formal notification
Tax return corrected The company has amended its return or fulfilled the identified obligation Confirm that the filing, payment, and accounting treatment are consistent
Further clarification required DJP still needs documents, explanations, discussions, or a visit Address each remaining issue with clear evidence
Another compliance review New data or a broader issue requires further examination Review similar transactions, periods, and tax treatments
Referred to a tax audit The unresolved issue requires formal examination Prepare the tax position, supporting records, and audit response strategy

What Happens After a Company Responds to SP2DK?

Under Minister of Finance Regulation No. 111 of 2025, effective January 1, 2026, taxpayers generally have 14 days to respond to a Request for Explanation of Data and/or Information (SP2DK).

The response may include an explanation, fulfillment of the identified tax obligation, or both. A written extension of up to seven days may also be requested. After receiving the response, DJP reviews it against:

  • The issue stated in the SP2DK
  • Tax returns and accounting records
  • Contracts, invoices, and payment evidence
  • VAT and withholding tax records
  • Third-party data available to DJP
  • Any tax correction or payment made

The clarification process, documented in a BAP2DK, helps the company understand possible outcomes, making the process feel more predictable and manageable.

Submitting a response promptly demonstrates your commitment to compliance, helping the company feel more confident and in control until the matter is resolved.

How SP3 P2DK Shows the Status of the Case

An SP3 P2DK informs the taxpayer about the progress or outcome of the clarification process. It may indicate that the matter has been completed, canceled, corrected, reviewed further, or moved to another tax procedure.

For cases handled in 2026, companies should refer to the process set out in the Minister of Finance Regulation No. 111 of 2025. Receiving an SP3 P2DK doesn’t always mean that the company has been fully cleared.

The case is more likely to be completed when the notification confirms that:

  • The SP2DK has been canceled
  • The clarification process has been completed
  • The company’s explanation has been accepted
  • The required tax correction has been made
  • No further action is currently required

Further action may still be needed when it states that:

  • Additional clarification is required
  • Another compliance review will be conducted
  • New data is being examined
  • A tax audit is underway
  • A preliminary evidence examination is being conducted
  • The matter has been referred to another formal process

Companies should also confirm that all agreed actions have been completed, including document submissions, tax return corrections, payments, or final reconciliations.

When SP2DK Can Become a Bigger Tax Issue

SP2DK allows companies to resolve a tax discrepancy before it escalates to a formal process. However, the risk of escalation increases when the company:

  • Doesn’t respond within the required timeframe
  • Submits incomplete documents or explanations
  • Provides figures that conflict with tax returns or accounting records
  • Disagrees with DJP without sufficient evidence
  • Reveals additional tax issues during the clarification
  • Leaves a material tax exposure unresolved

In these cases, DJP may request further clarification, conduct another compliance review, or escalate the matter to a tax audit. A tax audit after SP2DK is not automatic, but it becomes more likely when the response doesn’t sufficiently resolve the issue.

What Companies Should Review After SP2DK

Even after the case is completed, companies should review why the issue arose and whether the same risk exists elsewhere. Key areas include:

  • The root cause of the discrepancy
  • Reconciliation between tax returns and accounting records
  • Completeness of contracts, invoices, payment records, and tax documents
  • Similar transactions or tax periods that may be affected
  • Internal review and approval controls
  • Consistency of future tax reporting

This review helps prevent the same issue from appearing in another SP2DK and strengthens the company’s overall tax compliance.

Frequently Asked Questions

What happens after SP2DK is answered?

DJP reviews the company’s explanation, documents, tax returns, and any corrections made. The issue may be completed, followed by further clarification, reviewed again, or escalated to a tax audit.

Does submitting an SP2DK response close the case?

No. Submitting a response doesn’t automatically close the matter. The company should wait for and review the tax office’s subsequent communication.

What is the SP3 P2DK?

SP3 P2DK is a notification that communicates the progress or outcome of the request for tax data and clarification.

Does receiving SP3 P2DK mean there are no tax issues?

Not always. It may confirm completion, but it can also communicate a correction, further review, audit, or another follow-up action.

Can SP2DK lead to a tax audit?

Yes. A tax audit may follow if material discrepancies remain unresolved, the company doesn’t respond, or the explanation isn’t supported by sufficient evidence.

How long does DJP take to complete an SP2DK?

There is no single completion period that applies to every case. The timeline depends on the complexity of the issue, the quality of the response, supporting documents, discussions, and the availability of new data.

Should a company amend its tax return after SP2DK?

A company should amend its tax return when its review confirms that the original filing was incorrect. The calculation, penalties, affected periods, and impact on other returns should be assessed first.

What documents should be retained after SP2DK?

Companies should keep the SP2DK, response letter, supporting documents, reconciliations, meeting records, tax corrections, payment receipts, and final notification.

What should a company do when it disagrees with DJP’s data?

The company should explain the reason for the disagreement and support it with contracts, calculations, reconciliations, invoices, evidence of payment, and other relevant documents.
