A business license (izin usaha), previously known as a permanent business license (izin usaha tetap), is issued by the Indonesian Investment Coordinating Board (BKPM) or Regional Investment Coordinating Board (BKPMD) to the company that was established in the framework of a foreign investment company (PMA), given as an operating permit to conduct commercial business activities in the field of trade in goods/services. For example, this business license is needed for construction license in Indonesia, license for restaurant in Indonesia, mining license in Indonesia, etc.
Based on the new regulation from the beginning of 2015, all new foreign companies and existing foreign companies that still do not have business license need to have a financial audit before they can apply for a permanent business license and also other connected licenses (import license, etc.) required from them. This new regulation aims to ensure that all foreign investors have actually realized their investment plans and have not only submitted them to Investment Coordinating Board (BKPM) for the sake of simply submitting them, which reportedly happened in the past.

A distributor’s license is valid for an indefinite period of time.
Trademark registration in Indonesia is regulated by Trademark Act No. 15 Year 2001. Trademark protection is only obtained by registration. Protection based on prior use for unregistered marks is not available. The application process includes a formal examination and an evaluation of distinctiveness and similarity with prior trademarks. During this period, any party can submit a challenge against the trademark application. A trademark registration in Indonesia is valid for 10 years and is renewable. This registration can include such as food and beverage registration Indonesia, food supplements registration in Indonesia, fintech registration Indonesia, among others.
